The Truth About Credit Repair & Credit Repair Companies
credit repair law firms
"We can remove bankruptcies, judgments, liens and bad loans from your credit file forever!"
If your credit is too bad, these types of ads can be very attractive. This is especially true if you want to buy a home, finance a car or are just tired of dealing with bad credit.
The problem is that it is very difficult for most consumers to really understand what credit repair can and can not do, as well as whether the company they are considering is legitimate. These companies promise, for a fee, to clean up your credit report so you can get a car loan. a home mortgage. insurance, or even a job. Some credit repair companies are scams. Your goal is to "help" your customers by any means necessary, whether they are legal or not. They have no problem breaking the law, and they can use tactics such as:
Segregation Archive: Consumers are advised to apply for the IRS to an employer identification number ("EIN") and then use the EIN instead of their Social Security number when applying for credit in order to of creating a new credit file in which the old debts will not appear. The scheme essentially involves an attempt to hide creditors' identity, obtaining credit with the EIN, and a name and address that differ slightly from the precise identifiers. It's illegal.
Identity theft: Consciously or not, the consumer applies for credit using information from another person who has been robbed. Another variation is reporting unpaid debt as accurate as "fraud" in order to avoid paying it. To do this, the consumer will have to fill out a police report and lie. This is also illegal.

Most credit repair companies, however, are not using illegal tactics. And many of them really want to help their customers improve their credit. How do they try to do this? In general, there are three steps to the service that these credit repair organizations offer:
Companies ask you to pass them copies of your credit reports (usually from the top three credit reporting agencies - Equifax, Experian, and TransUnion), which you must obtain directly from these agencies;
The credit repair organizations then recommend that the items on your credit report that you must dispute;
Credit repair organizations then get in touch with the credit reporting agencies to challenge questionable items on their credit reports.
Credit reporting agencies are required under the Fair Credit Reporting Act (FCRA) to correct or delete inaccurate, incomplete or unverifiable information, usually within 30 days. They are not required to remove accurate information unless it is more than seven years old (or bankruptcies that are more than ten years old). If the information that is challenged is confirmed, it will be removed. And this is what these companies are often doing - writing and submitting dispute letters on behalf of their client.But here 's the thing: you have the right to dispute any incorrect or incomplete information on your credit report yourself - and the credit information agency should investigate the dispute at no cost to you.
Why Do Consumers Use Credit Repair?
So, why do consumers use credit repair? Usually one (or more) of three reasons:
They believe that credit repair companies have methods to get rid of information that are known only to them;
There are errors in your credit reports that are unable to correct themselves;
They are overworked and just want someone to take care of it for them.
If you are thinking of using one of these companies because you think they have some sort of "secret sauce" you may be wasting your money. There is nothing they can legally do that you can not do alone. You can get your own credit reports for free once a year, and you can dispute the negative information yourself. If the information is not verified at the source, it will be removed. Sometimes it works, and sometimes it does not. There is no magic language you have to use (in fact, it is best if you do not try to quote consumer protection laws - which is usually a tip that you are trying to use credit repair) and all it costs you is one stamp.If the reason you want to hire one of these companies is because there are errors in your credit reports that you have not been able to correct then you may want to first try filing a complaint with the Financial Protection Consumer Bureau. They usually contact the credit information agency on your behalf, for free. (Note - if you have not disputed the information with the credit reporting agency that is reporting this, do not file a complaint with the CFPB. .) And if that does not work, you may want to consider consulting a consumer law lawyer experienced in credit damage cases. If you have a good case, you may be entitled to compensation.
However, if you do not feel that you have the time to do this on your own, if you are are overwhelmed by the process, or if you just want to turn the whole thing to the pros, there are some basic rules for choosing one reputable company to help you repair your credit.
According to the FTC, the main warning signs of credit repair scheme companies are:Companies that want you to pay for credit repair services before providing any services. Credit repair companies may not require you to pay until they have completed the services they promised.
Companies that do not tell you their legal rights and that you can do for yourself for free.
Companies that recommend that you do not contact a credit reporting company directly.
Companies that advise you to dispute accurate information on your credit report or take any action that seems illegal such as setting up a new credit identity. If you follow illegal advice and commit fraud, you may be subject to prosecution.
In 1996, the Credit Repair Organizations Act (CROA) was signed into law to protect the public from unfair or deceptive advertising and commercial practices by credit repair organizations. By law, credit repair organizations must give you a copy of the "Consumer Credit Rights file under state and federal laws" before signing a contract. They should also give you a written contract that states your rights and obligations. Read these documents before signing anything.
The law contains specific protections for you. For example, a credit repair company may not:
Making false claims about your services.
Charge it until you have completed the services promised.
Perform any services until they have your signature on a written contract and have completed a three day waiting period. During this time, you can cancel the agreement without paying any fees.
Your contract should specify:
The terms of payment for the services, including their total cost.
A detailed description of the services to be run.
How long will it take to achieve the results.
Whatever guarantees they offer.
The company's name and business address.

Before you spend money on one of these services, you may want to try to fix your credit yourself. This is especially true if the rates that one of these companies will charge is money that you really can not afford and you would be better off using it to pay off other debts, or toward a down payment on a home or a car.
You can check your credit score each month using Credit.com's free Credit Card report. This completely free tool will break your credit score into sections and give you a grade for each. You'll see, for example, how your payment history, debt and other factors affect your score, and you'll get recommendations for the steps you may want to consider to solve the problems. In addition, you'll also find credit offers from lenders who may be willing to offer you credit. Checking your own credit reports and punctuation does not affect your credit score in any way.
Is there something about your credit that you do not understand? Use the search box on Credit.com to find an article on the subject. You will find dozens of stories about specific credit report topics such as queries, collection accounts, and how the final payments affect your credit. If you still do not understand the theme after reading these articles, you can leave a comment. Our experts often answer questions about the blog.
There is a lot you can do to make your credit stronger on your own. If you still need help then you will at least go for the understanding of the credit repair process you are paying for.

www.Credit.com/ Gerri DetweilerI do not object to credit repair conceptually, but I have a hard time recommending most (not all) paid credit repair options. Most of the time consumers who hear do not understand that what they are really paying for is for a company to do the job for them (or what that job actually involves - which is often to form letters). Instead, they either believe (or are led to believe) that these companies can do things they can not do themselves, including somehow removing all seriously negative information regardless of accuracy and / or increasing their score dramatically in a short time period if that's true or not.
I understand that sometimes consumers need help or guidance, and if they really understand what they are getting into when they buy credit repair, then that's one thing. But I hear from consumers who believe that for the right price - sometimes thousands of dollars - their bad credit can go away quickly. I just talked to someone in this situation last week who was about to spend $ 2800 she really could not pay.
When consumers would be better off using this money to settle debt or even to build savings to avoid future credit problems, then that's when I think they need to weigh their options. And if you teach them what they can do on their own for free is self-service, then I admit to being guilty of prosecution!
All I have to say is watch out for Best Credit Repairer in NJ, the guy will take your money and do not disappear returning your calls, letters anything but he will keep an eye on your credit and once you stay fed up chasing it and end up fixing your credit report if it will sue you for more money. The contract says it will take you to a certain score within 180 days, but BCR does not provide any proof of that score or anything, they simply sue you and even the James Mayer lawyer who represents BCR is involved in the scheme as your company will forge your signatures in the court papers to make it appear that it is notifying but they do not contact you for more than a year and than invent lies as you will not believe to win the judgment based on technicality that the client has had enough time to respond to the judgment, but how can someone respond to something that they do not even know. I bought cars etc after I had the trial but no one told me about it. I discovered when I had to rent a house that there was a trial. by the time i filed a motion to vacate (with concrete evidence) it was already too late and the judge said that I should have done something earlier and denied the motion, so basically BCR and James Mayer won the prize for more organized criminals in the state of NJ ! to add insult to injury I had to pay over $ 1000 to get rid of these guys and when I went to James Mayer's office a guy Gregory left and I swear he initially thought he was a homeless person the way he did was wearing dirty clothes and smelled. (No lie) his office was a notch, not a real law office. so be careful if you want to fix your credit, you can simply go to Experian or the other site and dispute information in minutes online. There is always fall for credit repair companies.
Repair of credit and credit repair organizations Act
credit repair law firmsConsumers with bad credit score often consider using a credit repair company to help fix their credit score. Credit repair companies can be beneficial to help guide you through the credit repair process, informing you about your options, and working with you to fix your poor credit score. However, you should carefully consider and thoroughly research the credit repair company that you are considering as the credit repair industry has seen its fair share of illegitimate business.
As a general rule, you can clean up your own credit score in the same way that a credit repair company can fix your bad credit score if you are willing to spend the time to do so. Whether through a credit repair company or through your own efforts, credit repair tactics usually include the removal of incorrect information from your credit file.
Unsecured credit repair tactics include:
Removal of correct but damaging information from your credit file. Although rare, sometimes a credit bureau will remove harmful information that is actually correct. These changes may be temporary as the lender will likely report the information again within 30-60 days.
Presentation of segregation, which involves creating a new identity to hide unfavorable credit history items. This is illegal.
Apply for an IRS employer identification number and use it to apply for new lines of credit. This is a federal constitutional crime fraud on the government and is punishable by fine or imprisonment.
The Federal Credit Repair Organizations Act, 15 USC § 1679 ("Law"), governs all businesses or individuals that improve consumer credit records, history or ratings, or advise consumers on improving their credit. The Act establishes the following requirements / prohibitions of all credit repair companies or individuals:It is illegal to make any false or misleading representations or representations or advise consumers to make false representations or representations with credit bureaus or credit providers.
It is illegal to charge for prepaid services. Payment can only be made after the promised service is fully paid.
It is necessary to provide any consumer with a separate written statement containing a notice with required legal language notice of the consumer's limitations and for the credit repair company to repair the credit score and history, inform the consumer of their right to sue the company credit repair, if they commit fraud, and inform the consumer of the self-help remedies available.
It is ineffective to get consumers to agree to waive any of the Act's protections.
The law gives law enforcement authority to the Federal Trade Commission or the state attorney general. Consumers can also file a lawsuit to recover most of the amount paid or actual damages, punitive damages, costs and attorney fees. There is a 5 year statute of limitations to bring any claim under this Act. Failure to file a claim within 5 years constitutes a waiver of the legal right to file a claim under the Act. Some credit repair organizations have remained around the regulations in the Act, defining themselves as non-profit organizations.
If you would like to verify the legitimacy of a particular credit repair services in Minnesota, contact the Minnesota Department of Commerce- the state agency authorized to license the debt counseling and credit repair services. You should make sure that the company is licensed to conduct business in Minnesota before retaining your services. If the company claims to be a non-profit organization, you can contact the Minnesota Attorney General's office to verify that it is registered in Minnesota. You can also contact the Better Business Bureau to check the company's reputation.
